SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Claycomb Chalets (Julie Claycomb) (“Homeowner”) and Dave Schwartzenberger (“Guest”) as of the date last set forth on the electronic signature of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property. The property is located at 114 Claycomb Chalets Lane, Champion, Pennsylvania 15622


2. Rental Party: The rental party shall consist of the Guest and the following persons:



  • Rental Rate. Payment in full of the following fees shall be due within 30 days of the Check-in Date: May 27, 2022

The property is furnished and includes Wood Burning Fireplace, Stocked Firewood, and Front & Back Wooden Decks. Charcoal BBQ Grill, Electric Heat, Full Kitchen, Coffee Maker, Toaster, Cookware, Dishes and Utensils, Glassware, Microwave Oven, Dining Area, Hulu Love Television, High-speed wireless Internet, Netflix Movies.

3. Maximum Occupancy: The maximum number of guests is limited to 7 persons unless otherwise stated in this agreement.

4. Term of the Lease. The lease begins at 3 p.m. on May 27, 2022 (the “Check-in Date”) and ends at 11 a.m. on May 29, 2022 (the “Checkout Date”). No early check-ins or late check-outs, please.

5. Minimum Stay: This property requires a 2-night minimum stay. More extended minimum stays may be required during holiday periods. If a rental is taken for less than 2 days, the guest will be charged the 2nd night rate.

6. Rental Rules: The guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else the Guest permits on the property to abide by the following rules at all times while at the property.

7. Access: The guest shall allow Homeowners access to the property for purposes of repair and inspection. The homeowner shall exercise this right of access in a reasonable manner.

8. Rental Rate and Fees

If the premises appear damaged upon Check-in, the Guest shall inform Claycomb Chalets immediately.

9. Cancellation Policy: If the Guest wishes to cancel his/her reservation, the deposit will be refunded as follows:

50% if canceled 15 days prior to the Check-in Date

100% if canceled 30 days prior to the Check-in Date

** You will only be refunded the amount you have been paid less any service fees or credit card transaction fees charged for the original transaction. These fees could be as high as 10% of your total payment. No exceptions. **

10. Insurance: We encourage all renters to purchase traveler insurance. Below are some references you may contact to buy such insurance:

11. Payment: Acceptable payment methods are Credit Card, or PayPal Only. NO PERSONAL CHECKS WILL BE ACCEPTED. If you wish to use a credit card, please use the link provided in the payment email or contact us to send you a payment request via online invoice.

I hereby give permission to charge my credit card for the amounts above by my signature below. I agree that all rental monies are non-refundable per the cancellation policy above. I have read my rights to purchase travel insurance.




Exhibit A

RENTAL RULES

  1. Smoking is allowed outside only. If you smoke inside you will be subject to a minimum $500 cleaning fee and will not be allowed to return to the property in the future.


  2. People other than those in the Guest party set forth above may not stay overnight on the property. Any other person on the property is the sole responsibility of the Guest. A maximum of 7 guests per cabin at any time is strictly enforced.


  3. All of the Chalets are privately owned; the owners are not responsible for any accidents, injuries, or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. The Chalets are authentically built and like any rustic-style dwelling may present a higher risk for personal injury than a modern dwelling. All guests in your party must take extra precautions and assume all risks when using the staircases and ladders to the lofts, walking on decks and stairways, traversing the property grounds during winter and rainy seasons and be wary of poisonous and dangerous vegetation, including but not limited to poison ivy, poison sumac and multiflora rose bushes than can be located on the property grounds.



  4. Keep the property and all furnishings in good order at all times. Furniture is not allowed outside of the Chalet at any time.


  5. Only use appliances for their intended uses


  6. PETS are permitted only with prior approval and the Pet Addendum must be completed. There is a non-refundable $100 additional pet fee for any pets staying on the property. Two (2) pet minimum. Pets are subject to certain breed restrictions. RESTRICTED CANINE BREEDS: Pit Bulls & Staffordshire Terriers, Doberman Pinschers, Rottweilers, German Shepherds, Chows, Great Danes, Presa Canarios, Akitas, Alaskan Malamutes, Siberian Huskies, Wolf-hybrids ARE NOT ALLOWED ON THE PROPERTY AT ANY TIME. NO EXCEPTIONS. We will email you a copy of our pet addendum for you to review prior to your stay.



  7. Parking: Parking is limited to 4 vehicles per Chalet. You agree to only park in your designated parking spots while visiting the property. Parking is not permitted in the grass or main drive-thru of the property. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. Overflow parking is available on a first-come, first-serve basis and must be pre-arranged with the property owner/manager.


  8. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring extra towels, sheets, and linens. We do not permit towels or linens to be taken from the units. There is a full-sized washer and dryer in each Chalet in the event you need to wash your linens during your stay.


  9. Noise: No guest shall make noise during their stay that can interfere with other guests' right to peace and privacy. Amplified music, car radios, loud parties, yelling and screaming, barking dogs, etc. WILL NOT be tolerated. We ask each guest to respect the privacy of others during their stay at the Chalets. Complaints from other guests or neighboring residences may result in the termination of this short-term rental agreement and refunds WILL NOT be issued.


  10. Fireplace: Each Chalet features a stone fireplace. The fireplace is a vented wood-burning fireplace. Please do not throw any paper or other combustible materials in the fireplace. Fireplaces may not be used to dispose of trash, wrapping paper, boxes, etc. Use of fireplaces may be restricted during certain times of the year or when fire danger in the area has been placed on high or extreme status. Wood for the fireplaces is provided on or near the front deck of each Chalet. NEVER, EVER leave a fireplace unattended! Any damage due to fireplace neglect will be the sole responsibility of the Guest.


  11. Water and Septic: The Chalets are on county water and septic systems. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clogged the septic system, you could be charged damages of up to $1,500 for emergency pumping and repairs to the septic lines. Do not let the water run in sinks or bathtubs for extended periods of time.



  12. Storms: If there is a storm or hurricane, no refunds will be given unless: The state or local authorities order mandatory evacuations in a "Winter or Tropical Storm/Hurricane Warning area" and/or A "mandatory evacuation order has been given for the Winter or Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. On the day that the authorities order a mandatory evacuation order in a "Winter or Tropical Storm/Hurricane Warning," area, we will refund: Any unused portion of rent from a guest currently registered; Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Winter or Tropical Storm/Hurricane Warning is lifted; and Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Winter or Tropical Storm/Hurricane Warning" period. No refunds will be given for non-evacuation winter storms. The mountain roads can be curvy and steep. Gravel drives are well maintained and plowed during winter storms; however, we highly recommend four-wheel drive and/or snow chains during the snow months. We do not refund due to road conditions. No exceptions.



  13. Power Failure: If there is a loss of power to your unit we ask that you contact the property manager or homeowner immediately. They will contact the power company to find out what the expected delay in power restoration may be and let you know. Refunds will not be issued for loss of power unless:

    Power is expected to be out for a period of 24 hours or more during your stay.

    Complete grid failure due to circumstances not related to weather.

    Loss of power originates due to the failure of transmission lines within the dwelling itself

    In the event the power is out for more than 24 hours, your refund will be prorated from the time the power failed until it was restored.



  14. Check-Out: You are responsible for leaving the cabin in the same condition that you found it with the exception of laundry. Please strip all beds and place sheets and any used bathroom towels in the laundry room or bathroom tub. We provide basic cleaning supplies under the kitchen sink and there is a broom and dustpan in the closet across from the laundry room. All dishes should be cleaned and put away, surfaces wiped down, and refrigerator and freezer left empty. When exiting the cabin please turn off all lights and turn the heat down but not off in the winter and the air conditioner off in the summer, and lock all doors and leave the ket hanging inside the door on the coatrack.
